Product Terms and Conditions and Privacy Policy Statement

The following terms and conditions govern all transactions between MiniMe Factory, its affiliates, and wholly owned subsidiaries (collectively “MiniMe Factory”) and you ("You" or "Customer").

Reproduction Of Your Likeness: Customer represents and warrants that he or she has the right to agree to the reproduction of their likeness and all accompanying accessories and attire. Customer represents and warrants further that he/she is of legal age and able to enter into a contract or is the legal guardian or custodian of the minor whose likeness is being captured. MiniMe Factory will not collect the image of a minor or produce any 3D MiniMe product for anyone under the age of majority without a parent or legal guardian's consent.

Customer Acknowledges: MiniMe Factory owns all rights, title and interest in and to the scan data and likeness in all formats and derivatives including 2D, 3D, digital, and physical created in any of our locations operated by MiniMe Factory, any our affiliate, partner or licensee including 2D conversions send to us. You hereby agree that MiniMe Factory may use such data and likeness for advertising, display, publication, or other purposes without limitation, unless you requested the removal of the 3D scan data pursuant to Section “Storage Of Data” below.

MiniMe Factory further reserves the right to alter or delete any request of well-known people or logos that may, in our sole judgment, infringe the intellectual property rights of third parties, if applied to MiniMe factory products.

Product Appearance: Slight differences may appear between you and your MiniMe Factory product due to the nature of image processing. MiniMe Factory further reserves the right to alter or delete from any product any trademarks or logos that may, in our sole judgment, infringe the intellectual property rights of third parties. The BobbleHead and Lego Head models are created using a simulated 3D rendering process that creates a close resemblance of the actual person’s face. This likeness may not appear photorealistic by design to give this product a fun characteristic.

Delivery: Your MiniMe figurine will be ready for pick-up in about 4-6 weeks. Other MiniMe Factory products may be shipped directly. Delivery times are not guaranteed. MiniMe Factory will make efforts to notify you in the case significant delays are expected.

Composition of Figurines: MiniMe Factory figurines are composed of sand powder mixture, binding, and infiltration material. The finalized material is fragile and should be treated with care to prevent it from breaking. Based on positioning and balance at the time of scan, not all MiniMe’s stand without support. In such cases, a base can be added during production if selected.

Warning: MiniMe Factory products are not toys and should be kept away from children. Small parts not for children under 3 years or any individuals who have tendency to place inedible objects in their mouth.

Product Care: Colors and detailing may wane over time and direct sunlight will lead to bleaching effects. Figurines should be kept away from moisture or chemicals and direct sunlight. Our optional wax coating can aid to slow down this process intensely.

Goods Sold “AS IS”: All MiniMe Factory products are sold on an “AS IS” basis. MiniMe Factory shall in no event be liable for any incidental, special, or consequential damages of any nature, even if MiniMe Factory has been advised of the possibility of such damages. No adjustment on previous purchases.

Return/Refund policy: All our products offered are custom made, which are created and designed fully based on individual customers. As a result, we will not accept the return or exchange of any MiniMe Factory products. If you selected and paid for delivery and your item arrives damaged due to incorrect handling from MiniMe Factory or the shipping carrier, please contact us at info@theminimefactory.com within 3 days of receiving your MiniMe Factory product to see how we may assist you.

Smart Phone Application: MiniMe Heads

By consenting to the terms and conditions you hereby understand that the items you are ordering using our iOS App (MiniMe Heads) are made to order items from your photos and that they are caricatured from your capture, not an exact 3D replica. You acknowledge that you have read the photo criteria and followed the guidance to complete your capture. Once your order is placed we do not allow alterations to images or sizing nor do we permit refunds to be given in the event that these terms were overlooked and blindly agreed to. If you ever receive an item from us that is incorrect and not the actual one you ordered you may contact our support team with your order number for us to investigate and exchange it for the correct product after verification.

MiniMe Factory respects our customers’ privacy, and customer privacy is of highest importance to MiniMe Factory.

Visitor Analytics: Visitor Analytics is a simple website analytics service which measures the traffic and visitors' general details of our website. Collecting these statistics, we can make our website visitors' experience better (e.g. which pages they visit and when, where they are approximately located, where does a user land first or if they are coming from a specific referral).
Basically, as a website owner using Visitor Analytics, we are using cookies to collect data about our visitors' device type and screen size, approximate location, browser, OS, IPs, page visits, bounce rate, conversions, and popular content on the website. All this data is pseudonymized and Visitor Analytics will never use the collected data to identify individual users or to match it with additional information on an individual user. Each visitor has control over the placement of cookies.

Visitor Recordings: Visitor Recordings is an additional feature to Visitor Analytics (described above) in the form of a simple website replay tool that records where our website visitors scrolled to and what they clicked on our website. We can see this information in playbacks and so called heat-maps. Collecting these statistics helps us to make our website more user-friendly and to reproduce and fix technical errors.
Basically, as a website owner using Visitor Recordings, we are using a snippet of tracking code to collect data about our visitors’ journey on our websites, so which sub-pages they visit, what they clicked on, where they moved their mouse cursor to and where they scrolled. All this data is pseudonymized and Visitor Analytics will never use the collected data to identify individual users or to match it with additional information on an individual user.

Collection of Date: We collect several types of information from you as you fill in forms online on our website, smartphone Applications, including when visiting our Studio. This includes customers names, addresses, email address, and images in various formats digital and prints. This information is shared among our affiliates, partners or licensees for the fulfillment of your orders. We, our affiliates, partners and licensees use this information to present our business, including our website, to you, provide you with information about our products and services, carry out our obligations and enforce our rights arising from transactions between you and us, including for billing and collection. We may disclose personally identifiable information as described in this Section to our subsidiaries, affiliates, partners or licensees, to comply with any court order, law or legal process, including to respond to any government or regulatory request or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of MiniMe factory, our affiliates, partners, licensees, or others.

Use of Personal Information: Your information is used solely to fulfill your order. In order to deliver our products, we need your name, e-mail address, payment details and your telephone number. This data allows us to process your request, contact you, provide our services, and keep you informed of the process. If it is necessary for delivering the products, we disclose your personal data to third parties. We will send you emails during your order progress to keep you updated and to follow up with you after you’ve received your order. We do not send marketing emails unless requested.

Storage Of Data: All digital files are encrypted on our database. MiniMe Factory preserves 3D scan data for ease of reprinting for 30-45 days. They maybe archived for longer in some cases. If you choose to have your data removed from our databases after delivery of the final product, please email us at contact@minimefactory.com and send a registered letter to MiniMe Factory, 5530 Windward Parkway, Suite 100A, Alpharetta, Georgia 30004 with your order number and request within 7 days of receiving your MiniMe Factory. No re-print will be possible after this action.

Change of Terms: MiniMe Factory may at any time revise these Terms by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the current Terms to which you are bound.

Add-on Disclaimer for online purchases:

By purchasing any of our items offered online, you agree to our Terms and Conditions. Specifically, you acknowledge and agree that the 3D fabrications are provided “as is”, “as available” and without warranty of any kind, expressed or implied, including but not limited to, the implied warranties of title, non-infringement, merchant-ability and fitness for a particular purpose, and any warranties implied by any course of performance or usage of trade, all of which are expressly disclaimed. Furthermore, you shall defend, indemnify, and hold harmless us, our affiliates, vendors, and each of our and their respective employees, contractors, directors, suppliers and representatives from all liabilities, claims, and expenses, including reasonable attorneys’ fees, that arise from or relate to your use or misuse of these 3D Models.
